Terms of Service

These Terms of Service ("Terms") govern your use of overdrive-it.net and any tools on it, including the self-assessment/risk-report tool (together, the "Site"), operated by OverDrive IT ("OverDrive IT," "we," "us," or "our").

By using the Site, you agree to these Terms. If you don't agree, don't use the Site.

1. Use of the site

You may use the Site for lawful purposes only. You agree not to:

• Misrepresent your identity or company when submitting forms
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems
• Use automated tools (bots, scrapers) to extract data from the Site without our written permission
• Submit false or malicious information through the self-assessment tool

2. The self-assessment tool

The self-assessment tool provides a self-reported, directional estimate of IT risk posture based on the answers you provide. It is:

• Not a substitute for a full technical audit, penetration test, or compliance assessment
• Not professional, legal, security, or compliance advice
• Based entirely on your own answers, which we don't independently verify

Any risk score, tier, or result is for informational purposes only. Decisions about your IT environment should be based on a full engagement with a qualified provider, not the self-assessment result alone.

3. Calls, texts, and email

By submitting your phone number or email address through the Site, you consent to OverDrive IT contacting you by phone, text message, or email about your request, your self-assessment results, and related follow-up. Texts may be sent using automated technology. Consent isn't a condition of any purchase.

• Rates. Message and data rates may apply. Your mobile carrier sets these charges, and OverDrive IT doesn't charge for texts.
• Frequency. Message frequency varies. Typically 4-6 texts over the course of two weeks.
• Opt out and help. Reply STOP to any text to stop receiving texts. Reply HELP for help, or contact us at the details in Section 13. Opting out of texts doesn't opt you out of email; use the unsubscribe link in any email.
• Your number. Give us only a number you own or are authorized to use, and tell us if it changes or is reassigned. Carriers aren't liable for delayed or undelivered messages.
• Privacy. How we handle your number and consent is described in our Privacy Policy. We don't sell your personal information.

4. Not a services agreement

Nothing on this Site, including the self-assessment result or any content you receive after submitting it, constitutes an offer or agreement to provide managed IT services. Any actual engagement with OverDrive IT is governed by a separate, signed services agreement with its own terms, scope, and fees.

5. Intellectual property

All content on the Site — text, graphics, logos, the self-assessment tool's design and questions — is owned by OverDrive IT or its licensors and protected by applicable intellectual property laws. You may view and use the Site for your own informational purposes; you may not reproduce, distribute, or create derivative works from it without our written permission.

6. No warranty

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the fullest extent permitted by law, OverDrive IT is not liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or reliance on the self-assessment result. Our total liability for any claim arising from the Site is limited to $0.00.

8. Third-party services

The Site relies on third-party services (including Close CRM, Cloudflare, Squarespace, and Google Workspace) to operate. We aren't responsible for outages, errors, or data handling by those providers beyond what's described in our Privacy Policy.

9. Indemnification

You agree to indemnify and hold OverDrive IT harmless from any claims, damages, or expenses arising from your misuse of the Site or violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any disputes arising from these Terms will be brought in the state or federal courts located in Illinois.

11. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes means you accept the updated Terms.

12. Termination

We may restrict or terminate your access to the Site at any time, for any reason, including violation of these Terms.
